Terms of Service — Biddit

1. Acceptance of Terms

By accessing or using the Biddit platform ("Platform"), operated by Biddit Technologies Pvt. Ltd. ("Biddit", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform. These Terms apply to all users including bidders, sellers, visitors, and administrators.

2. Eligibility

You must be at least 18 years of age and a resident of India to use the Platform. By registering, you represent and warrant that you meet these requirements. We reserve the right to verify your age and identity at any time. Users who are found to be under 18 will have their accounts terminated immediately.

3. Account Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately if you suspect unauthorised access. One account per person is permitted. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Bidding Rules

All bids placed on Biddit are legally binding commitments to purchase the item at the bid price if you win. By placing a bid you agree to pay the final bid amount if declared the winner. Minimum bid increments are set at 10% of the current price, rounded to the nearest ₹10. Anti-sniping protection extends auction time by 2 minutes when bids are placed within the final 60 seconds, up to a maximum of 5 extensions.

5. Pre-Registration Deposits

Certain auctions require a pre-registration deposit (typically 10% of the starting price) processed via Razorpay. This deposit is a hold — not a charge — to ensure bidder seriousness. Non-winners receive full refunds within 5–7 working days. The deposit may be forfeited if the winner fails to complete payment without valid reason.

6. Seller Obligations & Security Deposits

Sellers must provide accurate descriptions, authentic photographs, and honest condition reports. Sellers may be required to pay a security deposit (5% of the reserve or starting price) before their auction goes live. This deposit is released upon successful auction completion. Sellers who fail to deliver the sold item may forfeit the security deposit. Biddit is not a party to the transaction between buyer and seller.

7. Winner Payment Obligations

The auction winner must complete full payment within 48 hours of the auction closing. Failure to pay within this window may result in: (a) cancellation of the sale; (b) suspension of the winner's account; (c) forfeiture of the pre-registration deposit. A second-chance offer may be extended to the next highest bidder at Biddit's discretion.

8. Reserve Price Policy

Sellers may set a hidden reserve price below which they are not obligated to sell. The reserve price is not disclosed to bidders. If the final bid does not meet the reserve, the auction closes with no winner and no transaction occurs. All deposits are returned. Sellers cannot change the reserve price after an auction begins.

9. Mystery Box Terms

Mystery Box auctions conceal the product identity until auction close. The item is verified by Biddit's team prior to listing and is guaranteed to exist. No refunds are available on Mystery Box wins solely on the basis of product identity. All other standard terms (payment, delivery, condition guarantees) apply.

10. Shipping & Delivery

Sellers must ship items within 48 hours of payment confirmation. Sellers are responsible for adequate packaging. Biddit is not liable for damage caused by improper packaging. Shipping tracking information must be provided to the buyer within 24 hours of dispatch. Delivery disputes should be raised within 7 days of the expected delivery date.

11. Returns, Refunds & Disputes

Returns are accepted only if the item is materially different from the listing description (e.g., wrong item, fake/counterfeit, severe undisclosed damage). Disputes must be raised within 7 days of delivery via our dispute form. Biddit will mediate and may request evidence from both parties. Our decision on disputes is final. Refunds are processed to the original payment method within 5–7 working days of resolution.

12. Prohibited Items

The following are strictly prohibited on Biddit: weapons, ammunition, and explosives; narcotics, controlled substances, or drug paraphernalia; counterfeit goods or intellectual property violations; human remains or protected wildlife; items banned under Indian law; hate symbols or items promoting violence. Violation results in immediate account termination and reporting to relevant authorities.

13. Intellectual Property

All Platform content including logos, design, code, and text is owned by Biddit Technologies Pvt. Ltd. and protected under applicable Indian law. You may not reproduce, modify, or distribute our content without written permission. User-submitted content (photos, descriptions) remains your property, but you grant us a non-exclusive licence to display it on the Platform.

14. Limitation of Liability

To the maximum extent permitted by law, Biddit's total liability to you for any claim arising from use of the Platform shall not exceed the transaction amount involved, or ₹10,000, whichever is less. We are not liable for indirect, incidental, or consequential damages including lost profits or data loss.

15. Governing Law

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan. For disputes under ₹1,00,000, we encourage resolution via the National Consumer Disputes Redressal Commission online portal before approaching courts.

16. Changes to Terms

We may update these Terms from time to time. We will notify registered users via email for material changes. Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.
